CHAPTER II
OF THE NATIONAL ADVICE OF THE INDUSTRY ASSEMBLY PLANT DE EXPORTAClON
Article 5: The National Council of the Industries Assembly plants of Export, (CNIME) is created as Advisory Organism of the Ministries of Industry and Trade and of Exchequer that will be integrated by the following members named by the Executive Power to proposal of the respective distributions:
a. A representative of the Ministry of Industry and Trade.
b. A representative of the Ministry of Exchequer.
c. A representative of the Central Bank of the Paraguay.
d. A representative of the Technical Secretary of Planning for the Economic and Social Development.
e. A representative of the Ministry of External Relationships.
The CNIME will be able to invite to its sessions to representatives of other dependences or entities of the Public Administration, as well as to departmental or municipal representatives or of institutions or organisms of the public sector or private, when they consider it of interest for the best execution in its objectives.
The CNIME will be presided over by the Ministry of Industry and Trade. Also, each institution will have a regular representative and another alternative. The members of the Council will be people with suitability to exercise this position and they won't receive remuneration for these functions.
Article 6: The CNIME will have the following functions:
a) to Formulate and to evaluate the general limits and for branches, of politicians for the development and operation of Industries Assembly plants and to establish the strategies to continue with the purpose of achieving the maximum integration to the system of the basic matters and national inputs - through the subcontracts and to support the process of assimilation and adaptation from the technologies to be incorporated by these companies.
b) to Evaluate, to emit previous opinion and to communicate to both Ministries so that these they grant their authorization for Resolution in the following cases:
1. All the permits corresponding to these companies:
a. Program of activities.
b. Initial permission for the import of machineries and teams.
c. Permission for the import of basic matters and necessary inputs for the production.
d. Permission to modify, to enlarge, to reduce, to suspend or to cancel the Program of Assembling.
2. Transfer of machineries, tools and teams among companies with properly authorized programs.
3. Transfer of machineries and teams on the part of the companies assembly plants to the producers not. factory workers that are supplying.
c) to Enable Registrations of applications and of the antecedents of the granted authorizations.
d) to Rule on the matters that have relationship with the industries export assembly plants that are not foreseen in the precedent parentheses.
e) to Coordinate the action of all the institutions involved in the handling of the assembly plants.
Article 7: The National Council of Industries Assembly plants of Export will meet at least once a month, being able to the president to summon to extraordinary session when it estimates it pertinent or to petition in writing of anyone of its members.
Article 8: The Executive Secretary of the CNIME will be exercised by a representative proposed by the Ministry of Exchequer and will be the one in charge of the application of all that settled down in this Law and her regulations, as well as of the relating administrative handlings to the Industries Assembly plants of Export. This will be an university professional, Lawyer and/or Economist, suitable to exercise this position and will receive the remuneration that remembers for the position in the General Budget of Expenses of the Nation.
CHAPTER III
OF THE ASSEMBLING PROGRAMS
Article 9: An unique Center of Steps incorporated the CNIME Settle down, for the agile and quick handling of the different applications, permits and relative registrations to these companies.
Article 10: The interested ones in a Program of Assembling will present to the CNIME the application of approval of the same one, accompanied by the Contract of Assembling or of the Letter of Intention, in the form that settles down in the regulation for the effect.
Article 11: When it is accompanied alone a Letter of Intention of the assembly plant and of the foreign company, the same ones will have a term of 120 days to present the Contract of Assembling, counted starting from the date of the resolution that approves the Program, the one that will be conditioned to the presentation of the same one and the verification of the consistency in relation to the Letter of Intention. The lack of presentation of the same one, inside the established term will take place of full right the expiration of the agreed approval.
