REGISTRY AND PATENT OF MARK
A mark is a name, term, signal, symbol, sign or a combination of these, with which the products or services can be identified to differentiate them from others. The mark synthesizes the characteristics of the product or service, forming an image in the mind of the consumer.
In order to obtain a mark registry it is necessary to present/display the order in the Direccion de Propiedad Industrial (DPI) employee of the Ministry of Industry and Commerce, through an agent (authorized Lawyer for this effect), who will make it on the basis of the settled down norms in the Law of Marks (751/79 Law no. and its modification Law no. 1285/87).
The mark is a good of real value and constitutes the assets of the company. The holder of registered tradename must right to be against to the registry or use of any other than can induce directly or indirectly to the confusion, avoiding that others make the same present product or the same service with their registered tradename.
How a mark is registered
To present/display the order in the Direction of Propiedad Industrial (DPI) of the Ministry of Industry and Commerce (MIC), through the form Request of Registry of Mark properly completed and signed by the applicant and his represent lawyer (lawyer registered by the DPI as agent to make the proceedings of registries of marks).
The request must appear in "Mesa de Entrada" of the DPI, in where the Search of antecedents is made to verify that the mark Or has not been asked for or registered and later a term of 60 working days for manifestations is ordered the publication of the request of mark registry, granting itself of third and in case of not having opposition, the DPI grants the registry.
All the steps and exigencies are established in Law 751 of 1979. La duration of the proceedings to register a mark is of six months in ahead.
Term and Validity
The term of validity of the registry of a mark is of 10 years, counted as of the date of concession of the registry. The renovation request will have to appear within the year previous to the date of victory.
The registered tradename in single Paraguay has validity within the country.
